Terms of Service

Misd for Business (Pulse) · Effective October 23, 2026 · Version tos-2026-10-23

These terms are an agreement between your organization and Misd LLC, a Nevada limited liability company based in Las Vegas, Nevada ("Misd", "we", "us"). They govern your use of Misd for Business and its tools Pulse, Studio, Results, Watch, Ask and Connect, at misd.co/business and pulse.misd.co (together, "Pulse").

By creating an account or using Pulse you accept these terms, the Privacy Policy and the Service Agreement on behalf of your organization and confirm you are authorized to do so.

1. What Pulse is

Pulse delivers weekly intelligence cards about the area around the venues, events, and brands you claim, and, for online businesses, about the real-world markets behind your customers. Cards are built from aggregate real-world signals and verified business facts. Pulse describes patterns and makes suggestions. It does not guarantee business outcomes, and no card is a promise of revenue, attendance, or growth.

2. Your account

  • Provide accurate information and keep it current.
  • You must be authorized to act for any business or event you claim. We review claims and may deny or revoke any claim that we cannot verify or that conflicts with another claim.
  • Keep your credentials private. You are responsible for activity under your account.
  • Pulse is a business tool. It is not for personal or consumer use.

3. Plans and pricing

Current published pricing at the time these terms took effect:

  • Free card: one free intelligence card when you claim a property. The free card does not refresh and free accounts may be placed in a paused state.
  • Snapshot (online businesses): $99, charged once, for one week of cards. It does not renew. If you start an Online Pro plan within 14 days of the Snapshot purchase, $99 is credited against your first Online Pro payment.
  • Online Pro (online businesses; shown as "Pro" under Online on the plans page): $199 per month, month to month, or $1,990 charged once per year with a 12 month agreement. One online business.
  • Standard (small businesses): priced by location. $249 per month for the first location, with each added location priced lower than the last, up to 10 locations. Month to month, or charged once per year at ten times the monthly price with a 12 month agreement.
  • Pro (large businesses): priced by location. $499 per month for the first location, with each added location priced lower than the last, up to 10 locations. Month to month, or charged once per year at ten times the monthly price with a 12 month agreement.
  • Founders Club: a 36 month agreement with two payment structures: three yearly payments of $19,999 (default), or $59,997 paid in full upfront. There is no month to month option on Founders Club. Limited availability. Offered by invitation and conversation.
  • Custom / Enterprise: custom pricing and custom scope for portfolios beyond 10 locations, conferences, trade shows, festivals and zoned event spaces, arranged with our team under a separate order (see the Custom Account Service Agreement).

The per-location price schedule for Standard and Pro is published on the plans page and stated on your checkout page before you pay.

Plans sold before September 30, 2026 under the names Pro (formerly Rising Moon, up to 2 locations) and Elite (formerly Colossus, up to 10 locations), and Founders Club (formerly Eclipse) and Enterprise (formerly Andromeda), continue on the prices and terms under which they were purchased. Elite is no longer offered to new subscribers.

Published pricing may change. Price changes never apply mid-term to a term you have already paid for. For month to month plans, changes take effect at your next renewal after notice.

4. Rate lock

Some plans carry a rate lock. A rate lock means the price you pay does not increase while your subscription remains continuously active on that plan:

  • Online Pro, Standard and Pro: no rate lock. Plans renew at the published price after notice, and a price change never applies to a term you have already paid for.
  • Pro and Elite purchased before September 30, 2026 and charged yearly: your rate is held for at least 3 years from your first annual purchase, as granted.
  • Founders Club: your rate is held for the life of your membership, for as long as it remains continuously active.
  • Custom / Enterprise: pricing follows your agreement.

A rate lock ends early if you cancel, if your subscription lapses for non-payment, if you change plans (your new plan's pricing then applies), or if Pulse is discontinued or materially wound down. A rate lock that ends is not restored on re-subscription. Rate locks granted under earlier versions of these terms (the founder rate, held for at least 5 years) continue as granted.

5. Billing, renewal, and cancellation

  • Subscriptions renew automatically until canceled. Payments are processed by Stripe. Your card statement shows "Misd".
  • Month to month plans renew monthly. You can cancel any time from your account; cancellation takes effect at the end of the paid period.
  • 12 month agreements are charged as a single payment covering the full 12 months. Canceling stops future renewals and never results in an additional charge; you keep full access through the end of the period you have already paid for.
  • 36 month agreements charged yearly are a payment commitment for all three yearly payments. Canceling stops any renewal beyond the agreement, but does not cancel the agreement itself: the remaining yearly payments of your 36 month term remain due and are charged on schedule, and your service stays active through the full term. To avoid future charges entirely, choose the paid-in-full option at purchase.
  • After a 36 month agreement completes, the plan continues at the published yearly price until canceled.
  • Changing your location count. On Standard and Pro you may reduce your location count from your account. The reduction takes effect at the end of the period you have already paid for; nothing is charged or credited mid-term. You choose which locations remain active. A location removed from your paid count keeps every card and edition already delivered to it and stops receiving new updates. Nothing is deleted. Adding locations is charged at the published per-location price.
  • Online Pro alongside a location plan. Online Pro is a separate plan for an online business. An organization on Standard, Pro or a Custom plan may add Online Pro; the two plans are billed and canceled independently. Standard, Pro and Custom plans do not downgrade to Online Pro. Closing your account cancels every plan on it.
  • Snapshot is a one-time purchase and does not renew. It is not refundable once the week of cards has been built, except as the 30 day guarantee provides for a first paid purchase.
  • Prices exclude any applicable taxes, which are added where required.

6. 30 day guarantee

Your first paid monthly or annual location or Online Pro plan includes a 30 day money back guarantee. Tell us within 30 days of the first charge on that plan and we refund that charge in full to your original payment method. One refund per business. Canceling the plan in your account does not issue a refund, even inside those 30 days; the guarantee is honored only when you contact us. Event plans, Snapshots, custom bills and Orders follow the terms written for them. The guarantee is a refund of the first charge, not a promise that any suggestion will produce a result.

7. Acceptable use

You agree not to:

  • probe, scrape, or attempt to extract individual-level data from Pulse, or attempt to defeat the aggregation thresholds that protect the people behind the signals;
  • resell, sublicense, or redistribute Pulse cards or data outside your organization;
  • reverse engineer the service or use it to build a competing product;
  • use another organization's account, or claim a business you are not authorized to represent;
  • interfere with the operation or security of the service.

We may suspend or terminate accounts that violate these terms. Where we terminate without cause, we refund any prepaid amounts for the unused remainder of your term.

8. Your license to card content

You own your business information. We grant you a non-exclusive license to use the intelligence cards and insights we generate for your internal business purposes. That license survives for content delivered while your subscription was active.

9. The data behind Pulse

Pulse is built on aggregate signals. We enforce minimum crowd thresholds throughout the service, and signals too thin to be safely aggregate are not shown to anyone at any price. See the Privacy Policy for the full commitment.

10. Availability and changes

Pulse is provided "as is". Weekly refresh normally lands on Sundays, and cards may briefly show a building state while intelligence refreshes. We continuously improve card modules and may replace a module with one of substantially equivalent value. We do not guarantee uninterrupted availability on self-serve plans.

11. Liability

To the maximum extent permitted by law, Misd's total liability arising out of or related to Pulse is limited to the amounts you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential damages, or for business decisions made using the service.

12. Changes to these terms

We may update these terms. We will post the new version at pulse.misd.co and, for material changes, notify the email on your account. Continued use after the effective date accepts the updated terms. Changes never shorten a term you have already paid for.

13. Studio

Studio writes the week's suggestions as things you can send: emails to a list you upload, notes to organizations found on public pages, social posts you download, and your monthly press release. When you send email or outreach through Studio, we send as you from the Google or Microsoft account you connect. We do not take on a sending domain for you. You own the list and you are responsible for having consent to write to each address. We use the list only to send as you. Studio also recommends leads: organizations near your business, found on public pages each week, with the address each one publishes for business contact. A recommended lead is always an organization, never a person from Misd's own data, and we do not promise any lead replies. Nothing leaves Studio unless you approve it.

14. Results

Results shows your year by month in three lines: a baseline from your connected totals or the numbers you enter, the same line with this week's sized suggestions added, and what actually happened. It also records what each suggestion you tried did against your own numbers. The lines are modeled from those inputs. They are not advice, a forecast, or a promise of revenue.

15. Governing law and contact

These terms are governed by the laws of the State of Nevada. Disputes will be resolved in the state or federal courts located in Clark County, Nevada. Questions: support@misd.co.
